Dokolo district in trouble for breach of contract

Dokolo- Ultimate Media and Events Lira has threatened to pursue litigation against Dokolo district local government over breach of contract.

On May 23rd this year the Ultimate Media and Events Lira applied to Dokolo district local government seeking to provide printing services for plastic IDs.

The Office of the Chief Administrative Officer (CAO) then wrote to the Ultimate Media and Events Lira on 26 May 2023 approving the request for the “Production of staff IDs at a fee of 18,000 per card produced” giving them the Education office block as their work station starting from May 29th – June 2nd, 2023.

However, it’s reported that the work was halted by James Apili Otto the district chairperson Dokolo during a standing meeting held at his office after claiming that the process of awarding the contract to Ultimate Media and Events Lira was not right. The district chairperson James Apili Otto is said to have verbally ordered the company not to continue performing the task

This prompted Ultimate Media and Events Lira to write to the district on June 8th asking them to harmonize the matter within seven days or else the company seeks legal redress but since then the district has reportedly not acted accordingly.

Through his lawyer Emmanuel Egaru of Egaru and company advocate, Carls Okello Olado, the Managing Director Ultimate Media and Events Lira has sent to Dokolo district local government a notice of intention to sue.

In the notice dated June 26, 2023 addressed to the Chief Administrative Officer Dokolo district local government, Emmanuel Egaru stated that;

Take notice that our client is immensely aggrieved by the intensions depicted from your act as it is illegal, fraudulent, malicious, offends the law and done in blatant disregard to our client’s rights and as a result of these manipulative actions, our client has suffered loss and immense distress, stress, anxiety and mental anguish for which we demand as follows;

i) That you cease any form of transaction that you are having with any other person in regards to the assignment you had offered our client as it is null and void.

ii) That you immediately restore the contract that existed between you and our client.

iii) That you compensate our client the sum of Ugx 50,000,000/= (Fifty million shilling only) for the expenses and losses he has so far incurred in a bid to fulfill his obligations which you have since frustrated.

iv) That you pay our client general damages of Ugx. 40,000,000/= (Forty million shillings only) for the inconveniences you have so far caused him.

v)That you pay our professional fees of Ugx. 15,000,000/= (Fifteen million shillings only) within seven days from the date of receipt of this demand notice.

According to Egaru, should Dokolo district local government have any intensions of having the matter settled amicably out of court they should do it within 14 days.

“Should you fail to comply with this demand, our express instructions are to commence a civil action against you in the court of law at your own expense, shame and embarrassment” Egaru explained in the notice.

Attempt to get a comment from the chief administrative officer Alex Felix Majeme was futile by press time as his telephone went unanswered.
